Wavee

We have kept you abreast of the issues surrounding the closure of popular and now-defunct penny auction site, Wavee.com, and just yesterday, we learned some more interesting news.

In an alert received by CBSAtlanta.com, the public was informed that the state of Georgia has ordered the shut down of Wavee. From the article, State shuts down penny auction site, orders refunds:

"State officials said Wavee was operating illegally because they were not registered with the Georgia Auctioneers Commission. Wavee has been ordered to stop operating and pay more than $200,000 in customer restitution."

Jon Sours, with the Governor's Office of Consumer Protection, was quoted as saying, "They have agreed to go out of business and remain out of business and we intend to absolutely hold them to the letter of that agreement... What they have now agreed to do is pay restitution in excess of $200,000. They will also pay civil fines and penalties of $50,000 and establish a trust fund to compensate other people who may not have fully come forward."

This should be a lesson to site owners to make sure that you are properly registered within the state in which you operate.

On the front page of Wavee.com, they have issued the following statement:

"We appreciate everyone who has supported Wavee, and we have done our best to provide the best entertainment shopping platform. Unfortunately, due to many challenges with this business, Wavee is now out of business. We intend to ship out any remaining product(s) that you may be expecting."

PennyBurners member, Sandman, has reported that he received an email this morning from Wavee, stating that they will ship his winnings by August 15, 2011. Have you received any communication from Wavee since they went down in early May? Tell us about it on the PennyBurners Penny Auction Forum.

Yesterday, we reported that penny auction site, Wavee.com has been down due to "technical difficulties" since May 2, 2011.

Over the past few days we've heard reports that Wavee has been calling bidders, offering them the cost that they paid on the number of items won but not shipped - not the retail price, but the price less bid credits. The alternative was waiting until October for shipment.

Others have reported that Wavee has offered them 50% of the items' retail value. When asked what would happen if the bidder declined the pay-out offer, Wavee said they would ship the remaining items in October.

We'd like to point out that October is still five months away - obviously well past any dispute windows for PayPal and/or credit card companies. While we cannot say whether or not Wavee will still be around come October, we do advise that all bidders be aware of their dispute windows and act accordingly.

On May 2, 2011, Wavee.com went down, citing "technical difficulties":

"Wavee Customers,

Unfortunately, Wavee is currently unavailable due to technical difficulties. We apologize for the inconvenience and are working to restore service.

We are continuing to ship normally during this disruption. If you have additional shipping questions, you may contact us here. We will post any information regarding the outage here on the website as it becomes known. We appreciate your patience.

After Swoopo's recent closing, with their newly-acquired site, OohILove following closely behind, could Wavee be next?

Since at least October of 2010, we've had members complain about Wavee's slow or non-existent shipping:

Wavee has also garnered negative reviews on sites such as PennyAuctionList and PennyAuctionScore; bidders are not happy.

While Wavee attempts to reassure their members that they will "ship normally" during this down-time, it really isn't much of a reassurance, given their poor history of shipping won items.

It seems Wavee has had a long history of "technical glitches". Could this be their last one?
